16.12.2024<\/strong><\/p>\n\n\n\n<p>Suriye\u2019de, bug\u00fcn ya\u015fanmakta olan geli\u015fmeler, bize tarihin \u00f6nemli d\u00f6n\u00fcm noktalar\u0131ndan biri olan, 19. y\u00fczy\u0131l ikinci yar\u0131s\u0131nda, ayn\u0131 co\u011frafyada, ne t\u00fcr geli\u015fmelerin oldu\u011funa bakmam\u0131z\u0131 gerekli k\u0131l\u0131yor.<\/p>\n\n\n\n<p>Nihayetinde, kar\u015f\u0131m\u0131zda istikrars\u0131zl\u0131\u011f\u0131yla dikkat \u00e7eken bir co\u011frafya, siyasal bilincini olu\u015fturmada zorlanan bir toplum, farkl\u0131 etnik ve dini yap\u0131lar\u0131n dile getirdi\u011fi, k\u0131sa d\u00f6nemli g\u00f6zlem ve tecr\u00fcbeleri g\u00f6z \u00f6n\u00fcne almak kadar, ayn\u0131 b\u00f6lgeyi ve toplumu uzun d\u00f6nemli olarak ele alman\u0131n da ka\u00e7\u0131n\u0131lmaz olarak \u00f6nem arz ediyor.<\/p>\n\n\n\n<p>Osmanl\u0131 Devleti\u2019nin merkezinde ba\u015flat\u0131lan ve ard\u0131ndan, Bat\u0131 Avrupa g\u00fc\u00e7lerinin siyasal, toplumsal ve dini gerek\u00e7elerle Osmanl\u0131\u2019y\u0131, Avrupa sistemine tabi olmaya veya \u2018davete\u2019 y\u00f6nelik talepleri oldu\u011fu ger\u00e7e\u011fi kar\u015f\u0131s\u0131nda, s\u00f6z konusu reform s\u00fcrecinin nereye evrildi\u011fi veya evrilmedi\u011fi kadar, bu uzun d\u00f6nemli reform s\u00fcrecinin 20. y\u00fczy\u0131l ikinci yar\u0131s\u0131ndan bug\u00fcne kadar ge\u00e7en s\u00fcre\u00e7te Suriye \u00f6rne\u011fi gibi \u00fclkelerde nas\u0131l bir sonu\u00e7 do\u011furdu\u011fu da \u00f6nemle ele al\u0131nmas\u0131 gerekir.<\/p>\n\n\n\n<p><strong>1839 ve 1856<\/strong><\/p>\n\n\n\n<p>19. y\u00fczy\u0131lda, Osmanl\u0131 Devleti s\u0131n\u0131rlar\u0131 i\u00e7erisinde, g\u00f6rece d\u0131\u015f\/uzak bir eyalet olarak yer ald\u0131\u011f\u0131 s\u00f6ylenebilecek olan Suriye\u2019ye y\u00f6nelik merkezin yani, <em>Pay-i Taht<\/em>\u2019\u0131n siyasi ilgisi, 1839 y\u0131l\u0131nda ba\u015flayan, 1856\u2019da g\u00fc\u00e7lendirilme iddias\u0131yla devam ettirilmeye \u00e7al\u0131\u015f\u0131lan Osmanl\u0131 Tanzimat\/Reform s\u00fcrecinin do\u011frudan bir etkisidir.<\/p>\n\n\n\n<p>Temelde, bu iki reform s\u00fcrecinin, Osmanl\u0131 siyasi ve b\u00fcrokratik elitinin \u2018de\u011fi\u015fim\u2019 y\u00f6n\u00fcndeki istek ve arzular\u0131 olsa da, bu de\u011fi\u015fim belirli kurumsal alanlarla konur.<\/p>\n\n\n\n<p>1839 ve 1856 reform s\u00fcre\u00e7lerinde, Bat\u0131 Avrupa g\u00fc\u00e7lerinin siyasal, toplumsal ve dini gerek\u00e7elerle Osmanl\u0131\u2019y\u0131 Avrupa sistemine tabi olmaya y\u00f6nelik talepleri -veya \u0131srarlar\u0131, hatta zorlamalar\u0131-, kayda de\u011fer \u00f6l\u00e7\u00fcde, ad\u0131na az\u0131nl\u0131klar denilen ve \u2018sek\u00fcler Avrupa\u2019n\u0131n dini ve humanist s\u00f6ylemleriyle \u015fekillenen bir kamuoyu bilincinin de talepleriyle \u015fekillendi\u011fini s\u00f6ylemek gerekir.<\/p>\n\n\n\n<p>Bununla birlikte, s\u00f6z konusu reform s\u00fcrecinin sesi g\u00fc\u00e7l\u00fc \u00e7\u0131kan i\u00e7 yani, Osmanl\u0131 b\u00fcrokrasi elitinin ve de yeni yeni ortaya \u00e7\u0131kmakta olan entellekt\u00fcelle\u015fme yolundaki sivil okur-yazar \u00e7evrelerin ve bunlar\u0131n Suriye co\u011frafyas\u0131nda var olan benzerlerinin rol\u00fcn\u00fc m\u0131?<\/strong><\/p>\n\n\n\n<p>Osmanl\u0131 merkezinde yani, ba\u015fkentte ortaya \u00e7\u0131kan, resmi ve sivil de\u011fi\u015fim taleplerinin bir benzerinin, i\u00e7inde Suriye\u2019nin de oldu\u011fu Arap topraklar\u0131nda da g\u00fcndeme gelmesini yukar\u0131da dikkat \u00e7ekilen i\u00e7 ve d\u0131\u015f ba\u011flamlar\u0131yla birlikte ela almakta fayda var.<\/p>\n\n\n\n<p>S\u00f6z konusu reform s\u00fcrecinin y\u00f6netilmesinin ve y\u00f6nlendirilmesinin ara\u00e7lar\u0131ndan biri, ilgili b\u00f6lgelere atanan valiler ba\u015fta olmak \u00fczere, b\u00fcrokratik erkan olurken, di\u011fer bir b\u00f6l\u00fcm\u00fcn\u00fc, ba\u015fta yerel e\u015fraf olmak \u00fczere, b\u00f6lgedeki okur-yazar, sivil, dini ve sek\u00fcler \u00e7evrelerin katk\u0131s\u0131 olu\u015fturuyordu.<\/p>\n\n\n\n<p>Suriye\u2019de reform s\u00fcrecinin, k\u0131smen 1839 ancak, daha \u00e7ok 1856 sonras\u0131na tekab\u00fcl eden y\u00f6nelimleri oldu\u011funu s\u00f6yleyebiliriz. En az\u0131ndan, elimizdeki veriler bize bunu s\u00f6ylemeyi olanakl\u0131 k\u0131l\u0131yor.<\/p>\n\n\n\n<p>Bu \u00e7er\u00e7evede, 1864 y\u0131l\u0131nda yap\u0131lan Eyalet Reform Yasas\u0131, merkez d\u0131\u015f\u0131nda Eyaletler\u2019deki idari sistemin i\u015flerli\u011fine y\u00f6nelikti ve bu s\u00fcre\u00e7, Suriye\u2019de 1866 y\u0131l\u0131nda ba\u015flad\u0131.<a href=\"#_ftn1\" id=\"_ftnref1\">[1]<\/a><\/p>\n\n\n\n<p>Benzeri d\u0131\u015f\/\u00f6teki eyaletler i\u00e7erisinde diyelim ki, Libya Hicaz, Arap Yar\u0131madas\u0131, Yemen gibi b\u00f6lgelerden ziyade, reform \u00e7al\u0131\u015fmalar\u0131nda \u00f6nceli\u011fin Suriye\u2019ye verilmi\u015f olmas\u0131n\u0131n anla\u015f\u0131l\u0131r maddi nedenleri bulunuyor.<\/p>\n\n\n\n<p>Bu durum, Anadolu s\u0131n\u0131rlar\u0131 d\u0131\u015f\u0131ndaki ilk eyaletin Suriye olmas\u0131 kadar, Suriye\u2019nin M\u0131s\u0131r ve Arap Yar\u0131madas\u0131\u2019na ge\u00e7i\u015fi sa\u011flayan \u00f6nemli bir co\u011frafi ve toplumsal aktarma organ\u0131 olma rol\u00fcn\u00fc g\u00f6z ard\u0131 etmemek gerekir.<\/p>\n\n\n\n<p><strong>\u0130slam hukuku, Avrupa hukuku<\/strong><\/p>\n\n\n\n<p><a>Osmanl\u0131\u2019da reform \u00e7abalar\u0131n\u0131n do\u011fas\u0131 dikkate al\u0131nd\u0131\u011f\u0131nda, \u0130slam Hukuku (\u015eeriat) temelli yakla\u015f\u0131m yerine, Bat\u0131 Avrupa siyasal sisteminin -ki, bunu Avrupa medeniyet s\u00fcre\u00e7lerine eklemlenen ve bu b\u00fct\u00fcnden bir par\u00e7a olarak kabul etmek gerekir-, unsurlar\u0131n\u0131 g\u00fc\u00e7l\u00fc bir \u015fekilde i\u00e7inde bar\u0131nd\u0131r\u0131yordu.<\/a><\/p>\n\n\n\n<p>Bir ba\u015fka ifadeyle s\u00f6ylemek gerekirse,&nbsp;
